Divorcing or thinking of it?

Our Family Law team is here to guide you through divorce and separation. In WA, the divorce system is ‘no fault’, meaning the Court does not consider the cause behind the marital breakdown. Before submitting a divorce application, both parties must have lived separately for at least 12 months.

For a divorce order to be sanctioned, the following must be established.

• the marriage has irretrievably broken down.
• adequate arrangements have been made for any children of the marriage under the age of 18 years.

A divorce order becomes final 30 days after being granted. Although it legally ends the marriage, it does not resolve property division issues.
