Appointing a power of attorney or guardianship

At some time in your life, you may face accidents or illnesses that take away your capacity to make financial, personal, lifestyle, or treatment decisions.

Depending on what decisions you’re capable of making, you may appoint someone to make decisions on your behalf. At Peter J Griffin & Co, we can assist with all the legal documentation and representation required throughout this process.

Enduring Power of Attorney

Enduring Power of Attorney (EPA) is a legal document that enables a person to appoint a trusted person – or people – to make financial and/or property decisions on their behalf.  The Enduring Power of Attorney document is also signed by the appointed Attorney of your choice. The enduring power of attorney is an agreement made by choice that can be executed the adult person whilst he or she is of sound mind with complete understanding of the nature and effect of the document they’re signing.

At Peter J Griffin & Co, our experienced lawyers can help you organise relevant documents that determine when your attorney gets power, the scope of what they will have authority over, as well as other terms and conditions as you require.

Enduring Power Of Guardianship

Guardianship is a legal relationship in which a guardian who is a legal adult is appointed by the State Administrative Tribunal (SAT) for an incompetent person who is incapable of looking after or taking reasonable decisions regarding their health and lifestyle or requires oversight. However, the guardian cannot take financial decisions on their behalf.

Our lawyers can help you in arranging for the appointment of an attorney or guardian, helping you get the documentation in order, specifying the scope of each party, when the process is activated, and any other aspects to attend to.
